Terms of Use

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate accounts that we believe belong to individuals under 18.

You may not use the Service if you have been previously banned or removed by Dink Connections, or if you are prohibited from receiving the Service under applicable law.

2. Account Creation and Security

To use the Service, you must create an account by providing accurate, current, and complete information, including your name, email address, date of birth, and other requested profile details. You agree to:

• Provide truthful and accurate information in your profile at all times.
• Maintain the security and confidentiality of your login credentials.
• Immediately notify us of any unauthorized access to or use of your account.
• Not create more than one account per person.
• Not transfer, share, or sell your account to any other person.

You are solely responsible for all activity that occurs under your account. Dink Connections is not liable for any loss or damage arising from your failure to protect your account credentials.

3. Profile Photo Requirements

All users must upload at least one profile photo to participate in the Service. Without a profile photo, you will not be able to access core features including discovering other users, sending or receiving likes, messaging matches, or appearing in search results.

Profile photos must:

• Clearly show your face and accurately represent your current appearance.
• Be photos of you — not of another person, celebrity, cartoon, or object.
• Not contain nudity, sexually explicit content, or graphic violence.
• Not include contact information, URLs, or promotional material.
• Not depict illegal activity or violate any third party's rights.

We reserve the right to remove any photo that violates these requirements and to suspend accounts with repeated violations.

4. Acceptable Use and Community Guidelines

Dink Connections is committed to maintaining a safe, respectful, and authentic community. By using the Service, you agree not to:

• Harass or bully other users, including sending threatening, abusive, or intimidating messages.
• Create fake or misleading profiles, impersonate another person, or misrepresent your identity, age, or intentions.
• Engage in spam or send unsolicited commercial messages to other users.
• Solicit money from other users or use the Service for commercial purposes without our prior written consent.
• Post or share content that is defamatory, obscene, pornographic, hateful, discriminatory, or otherwise objectionable.
• Stalk or attempt to contact users who have blocked you or asked you to stop communicating.
• Use the Service for any illegal purpose or in violation of any applicable law or regulation.
• Attempt to circumvent any security feature, rate limit, or access restriction of the Service.
• Use automated tools, bots, scrapers, or other software to access the Service or extract data from it.
• Upload viruses, malware, or any other harmful code.

Violations of these guidelines may result in warnings, temporary suspension, or permanent termination of your account at our sole discretion.

5. Messaging Conduct

Messaging is available between users who have mutually matched. You agree that all messages you send through the Service will be respectful and appropriate. The following messaging conduct is prohibited:

• Sending sexually explicit, obscene, or graphic messages without the recipient's clear consent.
• Sending threatening, harassing, or abusive messages.
• Repeatedly messaging a user who has indicated they are not interested.
• Sharing another user's private information (photos, contact details, location) without their consent.
• Using messages to promote products, services, or external websites.

We reserve the right to monitor messages for safety purposes and to take action against users who violate these standards, including message removal and account suspension.

6. Subscription Plans and Features

Dink Connections offers three membership tiers with different features and benefits:

Feature availability and pricing are subject to change. We will notify users of material changes to subscription plans at least 30 days in advance. Your continued use of the Service after such changes constitutes acceptance of the updated terms.

7. Boosts

A Boost is a feature that highlights your profile to other users for a 40-minute window, increasing your visibility in the discover feed. Boosts are available as follows:

• Free members may purchase individual Boosts for $5.00 each.
• Basic members receive 1 complimentary Boost per week and may purchase additional Boosts for $5.00 each.
• Premium members receive 5 complimentary Boosts per week and may purchase additional Boosts for $5.00 each.

Boosts are non-transferable and non-refundable once activated. Unused complimentary Boosts do not roll over between weeks. We do not guarantee any specific outcome or number of profile views from using a Boost.

8. Payment and Billing

All payments are processed securely through Stripe, our third-party payment processor. By subscribing to a paid tier or purchasing a Boost, you agree to the following:

• You authorize us to charge the payment method you provide for the subscription fees or purchase amounts.
• Paid subscriptions automatically renew each month unless canceled before the end of the current billing period.
• You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; you will retain access to paid features until that time.
• We do not store your full credit card information. All payment data is handled by Stripe in accordance with PCI-DSS standards.
• Subscription fees are non-refundable except where required by applicable law.

If a payment fails, we may retry the charge and/or suspend your access to paid features until the payment is successfully processed. We reserve the right to adjust pricing; any price increases will apply to subsequent billing cycles after notice is provided.

9. Content Ownership and License

You retain full ownership of any content you submit, upload, or display through the Service, including photos, profile text, and messages ("User Content"). By posting User Content, you grant Dink Connections a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and modify your User Content solely for the purposes of operating, promoting, and improving the Service.

This license terminates when you delete your User Content or your account, except where your content has been shared with other users and they have not deleted it, or where removal is not technically feasible.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe upon the intellectual property or other rights of any third party.

All other content on the Service, including but not limited to the app design, logos, trademarks, graphics, and software, is the property of PeopleStar and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content without our prior written consent.

10. Reporting and Blocking

We provide tools to help you manage your experience on Dink Connections:

• Blocking: You may block any user at any time. Blocked users will no longer be able to see your profile, send you messages, or interact with you in any way. Blocking is mutual and immediate.
• Reporting: If you encounter a user who violates these Terms or makes you feel unsafe, you may report them through the app. Reports are reviewed by our team, and we may take action including warnings, temporary suspensions, or permanent bans.

We take all reports seriously and will investigate in a timely manner. However, we are not obligated to disclose the outcome of any investigation to the reporting user. Filing false or malicious reports may itself result in account action.

11. Account Suspension and Termination

You may delete your account at any time through the app settings. Upon deletion, your profile, photos, matches, and messages will be permanently removed from the Service, subject to our data retention practices outlined in our Privacy Policy.

We reserve the right to suspend or permanently terminate your account, without prior notice or liability, if we determine in our sole discretion that you have:

• Violated these Terms or our Community Guidelines.
• Created a risk or possible legal exposure for Dink Connections or other users.
• Engaged in fraudulent, harmful, or illegal activity.
• Provided false or misleading information during registration or in your profile.
• Failed to maintain a valid profile photo as required by Section 3.

If your account is terminated for a violation of these Terms, you are not entitled to a refund of any subscription fees or Boost purchases.

12. Safety and Meetups

Dink Connections facilitates connections between users but does not conduct criminal background checks, verify user identities beyond basic registration, or screen users in person. You are solely responsible for your own safety when interacting with other users, both online and in person.

When meeting someone from Dink Connections in person, we strongly recommend:

• Meeting in a public place, such as a pickleball court or recreation center.
• Telling a friend or family member where you are going and who you are meeting.
• Arranging your own transportation to and from the meeting location.
• Trusting your instincts — if something feels off, leave.

Dink Connections is not responsible for the conduct of any user, whether online or offline.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEOPLESTAR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• ANY WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
• ANY WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICE.

WE DO NOT GUARANTEE THAT YOU WILL FIND A MATCH, A DATE, A PLAYING PARTNER, OR ANY PARTICULAR OUTCOME FROM USING THE SERVICE. THE USE OF THE SERVICE IS AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEOPLESTAR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Service.
• Any conduct or content of any other user of the Service.
• Any interactions, meetings, or relationships arising from the Service, whether online or in person.
• Unauthorized access to or alteration of your transmissions or data.

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO DINK CONNECTIONS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless PeopleStar and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

16. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be addressed through good-faith informal negotiations. If the dispute is not resolved within 30 days of written notice, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against PeopleStar.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

18. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" at the top of this page. We may also notify you through the app or via email at our discretion.

Your continued use of the Service after revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

19. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PeopleStar regarding your use of the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries: These Terms do not confer any rights on any third party.
