Welcome to Dink Connections, a dating and social networking platform for pickleball enthusiasts, operated by PeopleStar ("we," "us," or "our"). By accessing or using the Dink Connections mobile application or website (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We reserve the right to request proof of age at any time and to suspend or terminate accounts that we believe belong to individuals under 18.

You may not use the Service if you have been previously banned or removed by Dink Connections, or if you are prohibited from receiving the Service under applicable law.

2. Account Creation and Security

To use the Service, you must create an account by providing accurate, current, and complete information, including your name, email address, date of birth, and other requested profile details. You agree to:

3. Profile Photo Requirements

All users must upload at least one profile photo to participate in the Service. Without a profile photo, you will not be able to access core features including discovering other users, sending or receiving likes, messaging matches, or appearing in search results.

4. Acceptable Use and Community Guidelines

Dink Connections is committed to maintaining a safe, respectful, and authentic community. By using the Service, you agree not to:

5. Messaging Conduct

Messaging is available between users who have mutually matched. You agree that all messages you send through the Service will be respectful and appropriate. The following messaging conduct is prohibited:

6. Subscription Plans and Features

Dink Connections offers three membership tiers with different features and benefits:

Feature availability and pricing are subject to change. We will notify users of material changes to subscription plans at least 30 days in advance. Your continued use of the Service after such changes constitutes acceptance of the updated terms.

7. Boosts

A Boost is a feature that highlights your profile to other users for a 40-minute window, increasing your visibility in the discover feed. Boosts are available as follows:

Boosts are non-transferable and non-refundable once activated. Unused complimentary Boosts do not roll over between weeks. We do not guarantee any specific outcome or number of profile views from using a Boost.

8. Payment and Billing

All payments are processed securely through Stripe, our third-party payment processor. By subscribing to a paid tier or purchasing a Boost, you agree to the following:

If a payment fails, we may retry the charge and/or suspend your access to paid features until the payment is successfully processed. We reserve the right to adjust pricing; any price increases will apply to subsequent billing cycles after notice is provided.

9. Content Ownership and License

You retain full ownership of any content you submit, upload, or display through the Service, including photos, profile text, and messages ("User Content"). By posting User Content, you grant Dink Connections a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, display, distribute, and modify your User Content solely for the purposes of operating, promoting, and improving the Service.

This license terminates when you delete your User Content or your account, except where your content has been shared with other users and they have not deleted it, or where removal is not technically feasible.

You represent and warrant that you have all necessary rights to grant this license and that your User Content does not infringe upon the intellectual property or other rights of any third party.

All other content on the Service, including but not limited to the app design, logos, trademarks, graphics, and software, is the property of PeopleStar and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our proprietary content without our prior written consent.

10. Reporting and Blocking

We provide tools to help you manage your experience on Dink Connections:

We take all reports seriously and will investigate in a timely manner. However, we are not obligated to disclose the outcome of any investigation to the reporting user. Filing false or malicious reports may itself result in account action.

11. Account Suspension and Termination

You may delete your account at any time through the app settings. Upon deletion, your profile, photos, matches, and messages will be permanently removed from the Service, subject to our data retention practices outlined in our Privacy Policy.

We reserve the right to suspend or permanently terminate your account, without prior notice or liability, if we determine in our sole discretion that you have:

If your account is terminated for a violation of these Terms, you are not entitled to a refund of any subscription fees or Boost purchases.

12. Safety and Meetups

Dink Connections facilitates connections between users but does not conduct criminal background checks, verify user identities beyond basic registration, or screen users in person. You are solely responsible for your own safety when interacting with other users, both online and in person.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PEOPLESTAR DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WE DO NOT GUARANTEE THAT YOU WILL FIND A MATCH, A DATE, A PLAYING PARTNER, OR ANY PARTICULAR OUTCOME FROM USING THE SERVICE. THE USE OF THE SERVICE IS AT YOUR OWN RISK.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PEOPLESTAR, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID TO DINK CONNECTIONS IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

15. Indemnification

You agree to indemnify, defend, and hold harmless PeopleStar and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another person or entity.

16. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be addressed through good-faith informal negotiations. If the dispute is not resolved within 30 days of written notice, either party may pursue resolution through binding arbitration in accordance with the rules of the American Arbitration Association.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against PeopleStar.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of such courts.

18. Changes to These Terms

We may revise these Terms from time to time. When we make material changes, we will notify you by posting the updated Terms on the Service and updating the "Effective Date" at the top of this page. We may also notify you through the app or via email at our discretion.

Your continued use of the Service after revised Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and delete your account.

19. Miscellaneous

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and PeopleStar regarding your use of the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is held to be invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

No Third-Party Beneficiaries: These Terms do not confer any rights on any third party.
